1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of www.varegenmed.com and any related pages, online store, account area and booking links (together, the "Site"). These Terms cover your use of the Site only. Medical, aesthetic and wellness services you receive in our office are also governed by the consent forms, financial policies and patient agreements you sign at the practice. If those documents conflict with these Terms, those documents control for the services they cover.
2. No Medical Advice; Emergencies
The Site is for general information only. Content about regenerative medicine, orthopedic care, shockwave therapy, hormone replacement, medical weight management, sexual wellness, injectables, aesthetics, skincare and spa services is not medical advice, diagnosis or treatment.
Using the Site, reading our blog, submitting a contact form or requesting an appointment does not create a provider-patient relationship. That relationship begins only after an in-person or telehealth evaluation by one of our licensed providers. Whether a treatment is right for you depends on that evaluation.
Always talk with a qualified healthcare provider before starting, stopping or changing any treatment, medication or supplement. Do not ignore professional medical advice or delay seeking it because of something you read on the Site.
If you think you are having a medical emergency, call 911 or go to the nearest emergency room. Do not use the Site, email, text or contact forms for urgent medical needs.
3. Eligibility, Accounts and Appointments
Eligibility. You must be at least 18 years old to use the Site, create an account or buy products. Services for anyone under 18 require a parent or legal guardian and are offered only at the practice's discretion.
Accounts. You are responsible for keeping your login details confidential and for all activity under your account. Give us accurate information and keep it current. Tell us right away at [email] if you believe your account has been used without permission. We may suspend or close accounts that violate these Terms.
Booking. Appointment requests made through the Site may be handled by a third-party scheduling provider. A request is not confirmed until we confirm it. We may decline, reschedule or cancel any appointment, including when a provider determines a service is not appropriate for you.
Cancellations and no-shows. Please give at least [24/48] hours' notice to cancel or reschedule. 4. Purchases, Specials, Gift Cards and Financing
Products and pricing. Skincare products, packages and specials sold through the Site are subject to availability. Prices, descriptions and promotions may change without notice. We may correct pricing errors and cancel orders placed at an incorrect price, with a full refund of any amount charged.
Specials and packages. Promotional pricing is valid only for the dates and terms stated. Unless stated otherwise, specials cannot be combined, have no cash value and are non-transferable. Prepaid treatment packages expire [timeframe] from purchase, subject to Virginia law. Gift cards. Gift cards are redeemable for services and products at the practice. They are not redeemable for cash except where required by law and cannot be replaced if lost or stolen.
Payment. Payments are processed by third-party payment processors. You authorize us and our processors to charge your selected payment method for all amounts due.
Shipping and returns. Shipped orders go to the address you provide; risk of loss passes to you on delivery to the carrier. Opened or used skincare products cannot be returned for hygiene reasons. Financing. Financing options shown on the Site are offered by independent third-party lenders. Approval, rates and terms are set solely by the lender under its own agreements. We are not a lender and are not responsible for lending decisions.

Individual results vary. Outcomes depend on your health, age, condition, lifestyle and adherence to care instructions. We do not guarantee any specific result from any treatment, product or program.
Before-and-after photos and testimonials. Photos in our gallery show actual patients who gave written consent. They illustrate possible outcomes and are not a promise of your results. Regulatory status. Insurance. Many of our services are not covered by insurance. You are responsible for confirming coverage and for all charges not paid by your insurer.
6. Privacy, Health Information and Communications
Privacy. Our Privacy Policy explains how we collect and use information through the Site. Health information you share as a patient is protected under HIPAA and described in our Notice of Privacy Practices.
Do not send health details through general forms. Contact forms, general email and social media messages are not secure channels for medical information. Please share health details only through our secure patient intake forms, our secure patient messaging, or directly with our staff at the practice. Secure forms are identified on the Site; if you are unsure whether a form is secure, call us instead.
Email and text messages. By giving us your phone number or email and opting in, you agree to receive appointment reminders, account notices and, if you choose, promotional messages from us. Message frequency varies. Message and data rates may apply. Reply STOP to opt out of texts or HELP for help; use the unsubscribe link to stop marketing emails. Your submissions. If you send us reviews, comments, questions or suggestions, you grant us a non-exclusive, royalty-free license to use them for operating and promoting our practice. We will not publish your name, photos or health information as a patient testimonial without your separate written authorization.
Third-party links and services. The Site links to or uses third-party services, such as booking, payment, financing and social media platforms. We do not control them and are not responsible for their content, policies or practices. Your use of them is governed by their own terms.
8. Disclaimers, Limitation of Liability and Indemnification
Disclaimer of warranties. THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ITS CONTENT IS COMPLETE OR CURRENT.
Limitation of liability. TO THE FULLEST EXTENT ALLOWED BY LAW, VRMS AND ITS OWNERS, PROVIDERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR PRODUCTS PURCHASED THROUGH IT WILL NOT EXCEED THE AMOUNT YOU PAID US THROUGH THE SITE IN THE 12 MONTHS BEFORE THE CLAIM, OR $100, WHICHEVER IS GREATER.
This section applies to your use of the Site only. It does not limit any liability for professional medical services that cannot be limited under Virginia law, including the Virginia Medical Malpractice Act.
Indemnification. You agree to defend, indemnify and hold harmless VRMS and its owners, providers, employees and agents from claims, losses and expenses, including reasonable attorneys' fees, arising from your violation of these Terms or misuse of the Site.
9. Governing Law and General Terms
Governing law and venue. These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Any dispute relating to the Site will be brought exclusively in the state or federal courts serving Fauquier County, Virginia, and you consent to their jurisdiction.
Changes. We may update these Terms at any time by posting a revised version with a new "Last updated" date. Continued use of the Site after changes are posted means you accept them.
Termination. We may suspend or end your access to the Site or your account at any time for conduct that violates these Terms. Sections that by their nature should survive, including ownership, disclaimers, limitation of liability, indemnification and governing law, survive termination.
Other terms. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with our Privacy Policy and Notice of Privacy Practices, are the entire agreement about your use of the Site. You may not assign these Terms; we may assign them in connection with a sale or reorganization of the practice.
